Advertising Terms & Conditions
ForSaleByOwner Magazine, Inc. is a real estate marketing company providing value added packages consisting of magazine advertisement, websites, attorney services, signs, education, etc. Offerings from affiliate websites (including ForSaleByOwner.com) may not be available though ForSaleByOwner Magazine, Inc.
UNDER CONTRACT/SOLDS – IMPORTANT: Seller understands & agrees upon (1) receiving an acceptable offer AND (2) once the closing has concluded to notify ForSaleByOwner Magazine, Inc.
ADVERTISEMENT PLACEMENT & CHARGES – All sales and services are final upon ad placement. There are no refunds for any services rendered (no exceptions). Magazine ad changes are free; however, changes must be submitted by 6:00 p.m. on the deadline date, which is published in the magazine and noted on the website http://www.homesbyowner.com/detroit. Changes can be called in, e-mailed or faxed to one of the numbers listed above. Homeowner should confirm receipt of changes. All ad renewals are subject to all of the terms on this agreement without regard to method in which renewal was made. We reserve the right to accept or reject any advertising placement. Advertisement rates are subject to change. These terms are binding with or without signature, and are also found on the website http://www.homesbyowner.com/detroit and click on the Terms & Conditions link. ForSaleByOwner Magazine, Inc. cannot be responsible for the operation of any website owned or operated by third parties. ForSaleByOwner Magazine, Inc. does not own or operate the websites included in the packaged programs. Publisher reserves the right to redesign any aspect of the magazine at any time.
ERRORS IN MAGAZINE – Due care and diligence is used in checking advertising copy for accuracy and to incorporate any changes made, but no warranty is given. Publisher will not be responsible or liable for misinformation, misprints, typographical errors, omissions, etc. Seller agrees to indemnify & hold harmless the publishers of ForSaleByOwner Magazine, Inc. for any damage, which may be suffered in the event information regarding said real estate is found, by judicial authority, to be in any way incorrect. If a wrong phone number is published, homeowner will receive one additional month of advertising to compensate. Under no circumstance, is homeowner subject for refund due to any error or omission.
INTERNET – Homeowner should verify their Internet ads for accuracy. Website changes (including additional specs/features) can be made and are the responsibility of the homeowner. Note: Changes made to the website ad do not automatically change the magazine ad (please refer to ADVERTISEMENT PLACEMENT & CHARGES)
HOME WARRANTY – If the Seller chooses to purchase a Home Warranty (optional) the Seller must inform ForSaleByOwner Magazine, Inc. when they have a signed offer with the buyer’s name, Title Company’s name and phone number to process the home warranty. The cost of the warranty is paid at closing.
TESTIMONIALS – After the sale of the property, ForSaleByOwner Magazine, Inc. will request testimonial from the Seller. Participation is completely voluntary. Seller understands and agrees that all testimonial statements and/or photographs submitted become the property of ForSaleByOwner Magazine, Inc. and may be used for promotional purposes.
IMPORTANT: A purchase offer is a legally binding document. Once it is signed, it is too late to change. For your benefit, we have included with all advertising packages “preparation and /or review” of the purchase offer (contract), by Real Estate Attorney- Phillip Campbell.
